Welcome to the website of Safety System Solutions (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, as well as the purchase of any original equipment manufacturer (OEM) products, training modules, consulting services, and Information Technology (IT) services (collectively, the “Services”).
By accessing our website, purchasing our products, or engaging our Services, you agree to be bound by these Terms.
1. Australian Consumer Law (ACL) Overriding Provision
Consumer Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.
Exclusion of Inconsistent Terms: To the extent that any clause in these Terms seeks to exclude, restrict, or modify any statutory right or remedy provided by the ACL, such clause will be read down or severed to the extent of the inconsistency.
2. Product Sales (OEM Manufactured Products)
Manufacturer Warranties: Subject to the ACL, where Safety System Solutions resells products manufactured by a third-party Original Equipment Manufacturer (OEM), the products are covered exclusively by the applicable OEM warranty.
Product Safety & Proper Use: Because we deal in safety systems, the Buyer acknowledges that equipment must be installed, maintained, and operated strictly in accordance with the OEM instructions, relevant Australian Standards (AS/NZS), and state-specific Work Health and Safety (WHS) regulations. To the extent permitted by law, Safety System Solutions is not liable for failures resulting from unauthorized modifications or improper usage.
Title and Risk: Risk of loss or damage to the goods passes to the Buyer upon delivery to the carrier or the Buyer’s nominated delivery address. Title to the goods passes only when full payment is received by us.
3. Training and Consulting Services
Training Bookings: Payment for training courses must be finalized prior to attendance. Cancellations made within 7 Days of the course date may incur a cancellation fee.
WHS Compliance Advice: Our consulting and training services are designed to assist with safety systems, but the ultimate legal responsibility for workplace safety and compliance under the Work Health and Safety Act 2011 (NSW) remains solely with you as the person conducting a business or undertaking (PCBU).
Reliance on Information: Our consulting recommendations are based entirely on the operational data and access provided by you. We accept no liability for outcomes resulting from incomplete or inaccurate information provided to our consultants.
4. Information Technology (IT) Services
Service Standards: We provide our IT, monitoring, and software services with due care and skill. However, we do not guarantee that our IT systems or hosting platforms will be entirely uninterrupted or error-free.
Data Security and Cyber Risks: While we implement robust security protocols, you acknowledge that no internet-connected system is entirely secure. Unless expressly covered under a separate Managed Service Agreement, you are responsible for maintaining your own independent off-site data backups.
5. Limitation of Liability
IMPORTANT LIABILITY NOTICE Except as provided by the Australian Consumer Law, the total liability of Safety System Solutions for a breach of a contractual term, a tort (including negligence), or a statutory guarantee is limited, at our sole option, to:
In the case of goods: The replacement of the goods, the supply of equivalent goods, or the cost of repairing the goods.
In the case of services: Supplying the services again, or paying the cost of having the services supplied again.
To the maximum extent permitted by law, Safety System Solutions will not be liable for any indirect, economic, or consequential loss, including loss of profit, loss of business revenue, or damages resulting from workplace downtime.
6. Intellectual Property
All training frameworks, course materials, software code, custom configurations, and website content developed by Safety System Solutions remain our exclusive intellectual property. You are granted a limited, non-exclusive license to use these materials solely for your internal business operations. You must not resell, copy, or redistribute our intellectual property to third parties without explicit written consent.
7. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Both parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and courts of appeal from them.
